William C. Erb, US attorney with over 34 years of legal experience, joins BMV as Of Counsel



BMV Law Tax & Finance is pleased to announce that William C. Erb, Jr., a U.S. attorney with over 34 years of combined legal experience in U.S. securities law, U.S. legislative and regulatory matters, and U.S. federal court litigation has joined the firm as of counsel.


William recently relocated from Washington, D.C. to Turin, Italy. Prior to joining BMV, William worked at the Securities and Exchange Commission (SEC) for seven years. Most recently, William was a Senior Counsel in the Division of Examinations at the SEC where he led complex examinations of SEC registered domestic and foreign investment advisers, including private funds and investment companies, to determine their compliance with U.S. securities laws, regulations, and rules.

He also served as Senior Counsel in the Office of Legislative & Intergovernmental Affairs (OLIA), located in the SEC Chair’s office, where he was a SEC point of contact for matters relating to U.S. Congress on securities laws and congressional oversight matters. At OLIA, William assisted in identifying SEC legislative priorities in coordination with the SEC Chair’s Office and other SEC divisions and offices, and worked to facilitate those goals with U.S. congressional and committee staff. William also prepared the Chair of the SEC and other SEC division directors for their testimony before the U.S. Congress, and assisted SEC commissioner nominees through the U.S. Senate confirmation process.

Prior to joining the SEC, William was an Attorney Adviser at the U.S. Department of Justice’s (DOJ) Office of Legislative Affairs (OLA) where he formulated and executed the DOJ’s legislative initiatives before the U.S. Congress, and articulated DOJ’s positions on proposed legislation. He also prepared DOJ witnesses, including the U.S. Deputy Attorney General and Assistant Attorneys General, for their testimony before the U.S. Congress. At DOJ, William also served as a trial attorney for 13 years in its Civil Division where he represented DOJ, Department of Homeland Security (DHS), Department of State, and the Federal Bureau of Investigation before United States Circuit Courts of Appeals and United States District Courts in immigration cases and related matters. While at DOJ, William argued numerous cases before U.S. Courts of Appeals in the Third, Fourth, Sixth, Seventh, and Ninth circuits, and served as lead counsel in four class action lawsuits defending challenges to U.S. immigration policy. In 2007, William was detailed to the U.S. Embassy in Rome, Italy, to work on DOJ immigration cases and advise DHS embassy staff on immigration matters.

Earlier in William’s career he was an Associate General Counsel in the Office of the General Counsel at the former Immigration and Naturalization Service (INS) where he provided legal advice to all branches of the INS on immigration and non-immigration matters.
